Arizona Legal Info
A landlord who operates only in a cost recovery mode and does not charge more for services than what the utility provider charges them is not considered as a public utility company by Arizona Corporation Commission. The administrative fees assessed for submetered utilities or bills that are calculated using Ratio Utility Billing Systems (RUBs) are subject to a sales tax. Arizona prohibits the use of a RUBS billing model for gas, water, and electricity in manufactured housing.

Arizona Submetering
The state of Arizona requires all large providers located in an Active Management Area to meter all water deliveries to municipal service connections on its systems. The only exceptions are connections to construction users, dwelling units in individual multifamily units, mobile homes using master meters, and fire service connections. Providers not located within an Active Management Area are not required by the state to meter water delivery. However, you are still required to follow any regulations set forth by the city, town, or county you are located in. Banyan is one of the leading utility submetering and billing companies in the state of Arizona. If you are a large provider we can help you pick the right equipment for your project. We work directly with new developers, managers, and property owners to promote effective water supply management through the use of submeters. By metering all service connections you give tenants the opportunity to see exactly how much water they are using on a monthly basis. It also allows property owners to easily identify high-water users and work with them on conservation efforts. Other benefits associated with submetering all water connections include the ability to charge for water based on actual use, enhanced detection of leaks, less administrative work, improved property value, better cash flow, and stabilized rent.
